To Work on The Books or Off The Books….Does it Really Matter?

      I gave this post what at first blush, seemingly, is a highly controversial subject…“To Work on The Books or Off The Books….Does it Really Matter”, however as you Read on here and in future posts on this Tax Forum…you will find that it is truly nothing more then a personal choice…That’s Right! Merely little more then a personal choice. If you take the time to research the question on taxes authorized to be levied by the U.S. government under Title 26 United States Tax Code…you will find what I found, or perhaps I should say was unable to find.
     
     True the United States Tax Code makes “earned income” taxable…however it is a little know fact that the definition of “earned income” under the code only refers to “Foreign earned income” and no specific section made part of Title 26 defines income earned within the United States as “earned income”, and hence according to the Tax Code itself, not mandatory to be claimed as taxable by placing any earnings made domestically within the United States on IRS Form 1040, or any other IRS Form for that matter.
     
     Being an accredited Freelance Paralegal, I think I should be able to hold myself out as a professional researcher, especially on the law. More over as an enrolled agent with a “CAF” Number (035-74082R) issued to me by the IRS authorizing me to represent others who are confronting tax audits or appeals, I submit, that I know more than a little something about Title 26/ also referred to as “The Code”, which is the Chapter of the United States Code that codifies all of the Nations Federal Tax Laws and the Code of Federal Regulation codifies the procedures used to implement the United States Tax Code (Title 26 U.S.C.A.).

     Now, most of us who have not been living under a “Rock”, or playing “hide and seek”, have long heard that the American Income Tax system is a “voluntary one”, and following my years of research on the subject matter, I must agree! (emphasis added). Based upon my research, I Find or learned, it is purely a personal choice to claim domestic earned income (that is income earned within the United States for labor, or services performed)…yes!, it is purely optional in the first place by the individual, and that is the reason why it has long been described by a great many people in the “Know”, as “voluntary”.
    
     Obviously, it may make sense for some to join the Federal Taxing System, while for a great many others, outright “silly”, especially in light of the absurd tax structure and our governments not so secret habit of dispensing huge handouts to some of the least deserving, funding… “Wars”, which with no exit plans, that we object to, giving “Financial Aid”, to Foreign governments who are not only… “Not”our friends or allies, and most often use the money to fund attacks against our Nation, harbor terrorists, or support and promote political dictatorship, which we truly ought to stand against, based upon their oppression, and Human Rights violation they wage against their own people, and these are just a handful of the good reasons why we should not volunteer to finance such shenanigans! While we are on the Topic let’s not forget about the “Pork Barrel” benefits the politicians tag onto legislation having nothing to do with their pet “Home Town” projects, and they accept as Hush Money!.agreeing not to let “The cat…out of the bag!”

     Additionally, according to Title 26 U.S.C.A., no person must file a tax return on domestic earned income, and cannot be arrested, charged or convicted according to the code, if they simply exercise the right to file either a “statement or a list”,in lieu thereof, which translates into, one cannot be arrested, prosecuted or convicted for failing to file a tax return on domestic earn income, that is precisely defined income which is not, subject to any mandatory tax, depriving the U.S. Attorney and the United States District Court of Jurisdiction “in persona” (over the person) and over the subject matter.
     
     Oh! and don’t feel bad!… you are still financing our government with the great many other Mandatory taxes they are authorized to levy and gleefully do so under the Federal Tax Code, and yes! The government can opt to pass and levy a specific “War Tax” , and we would be required to pay it as a mandatory tax, as authorized within the Code. They have done it before and can do it again!
    
     I feel certain that this post will most certainly trigger opposition views for all sorts of reasons, which go well beyond the law, but it is about time we start letting our federal government know that we are finished being fooled, unlawfully arrested, charged and convicted, at the hands of over eager Unites States Prosecutors, also, sick and tired of their long standing “secret”, which leaves it up to every potential tax payer to conduct self help research in order to find the truth, and make a decision for themselves based upon all of the facts.

     Additionally, for some it may be a benefit for them to pay the voluntary income tax, for the purpose of getting into the system allowing them to be covered by Social Security Benefits, (if they even exist when their retirement date and age for collection of benefits arrives) and or… SSI, which has no age, or Social Security Disability Benefits, which they may be eligible for earlier than the mandatory age(s) established to collect regular SS Benefits.

     This Forum as promised will take on the “hard and tough” questions, with an aim at providing the correct answers, as found within our American system of statutory law, or the “Law of the Land”, as set by decisions of our Nations Highest Court, The United States Supreme Court of America”.

     Once you educate yourself… through Forums such as this, perhaps you can pass your findings along to your attorney, or CPA, or other tax professional, who seem all to complicit, perhaps because they are being paid handsomely for your ignorance and their unfathomable silence! Think About It!… What happens to them, if the fear of the IR$ stops! Simple!, they too, stop lining their pockets, with your hard earned money!
